Mammmahood.com.au is owned by Benmarc Enterprises Pty Ltd, T/As Mammahood Clothing. 
From hereunder, all references to “we" and “us” refers to  Benmarc Enterprises Pty Ltd and/or Mammahood clothing. The following rules and regulations apply to all visitors to or users of the Mammahood website. By using this website, you agree to be bound by these rules and regulations, as they may be modified by us at any time and posted on this website.

Unless otherwise indicated, all materials on this website, and the website itself, are protected by copyrights, trademarks and/or intellectual property rights. These materials are owned by us. The mammahood website and all of its content, including, but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, video, and audio are the intellectual property of Benmarc Enterprises Pty Ltd. All content is provided by us as a service to its current and prospective customers and may be used for personal information and product ordering purposes and non-commercial use only. You may not copy, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license or otherwise exploit this site or any of its content without our prior written permission. You may not use this website, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own website. No license to the use of such marks, names or trade dress is granted to you under these terms and conditions or by your use of the Mammahood website. Your misuse of the trademarks displayed on the Mammahood website is strictly prohibited.

You agree that your access to, and use of our website is subject to these terms and all applicable laws, and is at your own risk. This website and its contents are provided to you on "as is" basis, the website may contain errors, faults and inaccuracies and may not be complete and current.

GST & Taxes

The Australian GST tax rate applies to all orders delivered within Australia.

Any duties and taxes incurred in the country of destination are the responsibility of the customer. If you require further information about your country's taxes and duties you will need to contact your local customs office directly.

To comply with Australian export regulations, we are required to declare the exact value of all items ordered and to mark them as dutiable 'merchandise'. We are also prohibited by law from marking the order as a 'gift', even if order is placed with the intention of sending to a gift recipient.

Your rights


As our customer, you have the right to expect that:


1. Any products you order through Mammahood.com.au will be of satisfactory quality, fit for their intended purpose, and will conform  to any description given on this site;


2. Certain remedies will be followed if a product is deemed to be defective/faulty; 


3. You have the choice of a full refund or a store credit if a defective/faulty product is unable to be repaired or replaced, (with the exception of Gift Card purchases where only a store credit will be issued).

Your activity


As an account hoder with us, you agree that you will be personally responsible for your use of your account and for all of your communication and activity on and pursuant to this website. If we determine that you are or have been engaged in prohibited activities, you are not respectful of other users, or otherwise violated our terms and conditions, we may deny you access to this website on a temporary or permanent basis at our discretion.

To use some of the services or features made available to you on mammahood.com.au you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. Pricing Policy

Prices on our website are displayed in Australian Dollars. Mammahood Clothing is based in Australia, and GST is chargeable on all orders shipped to Australian addresses. Orders shipped internationally do not incur GST and will be reflected in the total amount on the confirm order page where the shipping address is located outside of Australia.



Eligibility to purchase


We accept the following payment methods: Visa, MasterCard, direct debit & Paypal. With the exception of Paypal and Paypal credit card purchases all other credit card purchases will be processed and authorized by our approved payment gateway.



Purchasing products on our website is only available to individuals who meet our terms of eligibility. All purchasers must be over 18 years of age. All purchasers must have been issued with either a valid credit card by a bank and acceptable to Paypal or a valid Paypal account. The individual’s application to open an account must be acceptable to us, and the individual agrees to authorise Paypal, (on behalf of Benmarc Enterprises Pty Ltd) to process the charge or charges on their credit card or Paypal account in the amount of the total purchase price for the merchandise which they purchase.

Order approval


After you place your order, you will be sent an email confirming that it has been received and your credit card or Paypal account has been charged.
Your card is debited at the time you submitted your order on our website. If your order has not been approved you will be notified immediately via our website or by Paypal.
In the rare instance that your order is approved but any of the items you have ordered are not available, we will contact you immediately by phone or email to arrange for a full refund or product exchange if preferred. Unless you cancel your order, acceptance of your order and completion of the contract between you and us will be completed when we email you to confirm the goods have been dispatched. Our website and communication is always conducted in English and therefore the final sale contract will also be in English.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria.



Payment


We accept Paypal, Visa, Mastercard and direct debit payments. With the exception of Paypal and Paypal credit card purchases all other credit card purchases will be processed and authorized by our approved payment gateway. 


Shipping

We insure each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by us and transfer of responsibility in the same way.

 Please note that although we aim to dispatch orders made before 1pm the same day we cannot dispatch all orders immediately. Reasons we cannot dispatch an order the same day are as follows:


• Order was placed after 1pm (and will be dispatched the next business day)


• Order was placed on a Friday or public holiday (and will be dispatched the next business day)


• Order could not be fulfilled i.e. item is out of stock and we are sourcing options


• Courier delays or unavailability



In the event an order cannot be fulfilled, we will contact you immediately to arrange an alternative product or refund.

We cannot be held responsible for courier delays and circumstances out of our control. Estimated delivery times are to be used as a guide only and commence from the date of dispatch, we are not responsible for any delays and costs associated with and/or caused by destination customs clearance processes.

Delivery

Postage within Australia is charged at a flat rate of $5.00 AUD.

Postage of orders over $80 AUD is free within Australia.

For international deliveries, postage is dependant on Australia Post Standard International AirMail rates and can take up to two weeks. Postage costs are dpenedant on International Zoning Conventions of Australia Post. Returns, Exchanges and Cancellations

Our store policies are pretty typical, but for the sake of being formal here they are in writing:

We will gladly refund if you return your unused item/s in original condition within 14 days of the invoice date (28 days for international customers). Sale items will receive a store credit only.

Items must be returned in their ORIGINAL PACKAGING and CONDITION with tags attached. Please email our customer support at lanatruong@benmarc.com.au for a returns form to be sent out. Complete the form and send items to

We regret that items that have been worn or damaged or returned to us in an unsaleable condition will be denied a refund. Item will be posted back to you at the customers expense if requested.


Refunds can only be credited in the original form paid. All customers are responsible for the postage cost of returning any items to us. We are not responsible for any lost return parcels so please send back to us via a traceable method such as Australian registered post.


We will email you with notification once your return has been processed. Please allow up to 5 working days for your refund to appear on your statement.

Any special requests for refunds or late returns will only be considered under special circumstances and incur a $10 administration fee per item. This amount is automatically deducted from your refund amount.

There are no refunds accepted for change of mind or on discounted/sale items. We will happily exchange for size. 

On the rare occasion there is a lost parcel, we will endeavor to replace or provide a store credit once the parcel is deemed 'lost' by Australia Post. Please note that investigations can take up to 10 working days to be completed. In these instances, we thanks you for your patience.
